1. BROKER FEE DISCLOSURE
In addition to any commission received from an insurer, McNeilly Insurance Agency may charge a broker fee for services rendered in connection with the placement, procurement, or servicing of insurance on your behalf. This fee is separate from and in addition to the insurance premium charged by the insurer.
California law requires that any broker fee charged to a client must be disclosed in writing and agreed to by the client prior to the binding of coverage or the collection of any fee.
2. SERVICES PROVIDED
The broker fee covers professional services including analysis of insurance needs, research and comparison of coverage options, placement of insurance, policy review and explanation, and ongoing service and support.
3. FEE AMOUNT
The broker fee amount is as quoted and agreed upon separately between Broker and Client. By typing your full name and submitting payment through this portal, Client acknowledges and authorizes Broker to charge the fee amount entered on the payment form.
4. REFUND POLICY
Broker fees are generally non-refundable once services have been rendered. If coverage is not bound due to circumstances within the Broker's control, a full refund of the broker fee will be issued. Partial refunds may be considered on a case-by-case basis.
5. COMMISSION DISCLOSURE
Broker may also receive a commission from the insurer with whom coverage is placed. The existence of such commission does not reduce or offset the broker fee described in this Agreement.
6. CLIENT ACKNOWLEDGMENT
By typing your full name below and clicking “I Agree & Continue,” you acknowledge that:
- You have read and understand this agreement.
- You voluntarily agree to pay the broker fee entered on the payment form.
- You authorize McNeilly Insurance Agency to charge your payment method for the stated amount.
- You understand this fee is separate from any insurance premium.
7. GOVERNING LAW
This Agreement shall be governed by the laws of the State of California. Any disputes arising under this Agreement shall be subject to the jurisdiction of the courts of San Diego County, California.
8. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties with respect to the broker fee and supersedes all prior negotiations, representations, or agreements relating to the fee.
This disclosure is provided pursuant to California Insurance Code § 1760 et seq. and California Code of Regulations, Title 10, Chapter 5.
